Remains of a human fetus are defined as remains of the offspring of a human being that has died through abortion or miscarriage, and that has reached a stage of development so that there are cartilaginous structures, or fetal or skeletal parts. </P><P> Our comment: While it does cover a fetus, it does not cover all products of conception until after the 8th week of pregnancy. Again, this may not seem like a big deal to some, but it can to parents who have suffered a miscarriage early in the pregnancy. </P> <!-- END OF MINNESOTA --> <P><a href="#top">Back to top</a></P> <!-- MISSOURI --> <a name=mis><h1>Missouri</h1></a> <P> <h2>Missouri Revised Statutes Chapter 194 Death--Disposition of Dead Bodies Section 194.378 </h2></P><P> Final disposition of fetal remains, mother has right to determine. 194.378. In every instance of fetal death, the mother has the right to determine the final disposition of the remains of the fetus, regardless of the duration of the pregnancy. The mother may choose any means of final disposition authorized by law or by the director of the department of health and senior services. </P><P> <h2>Chapter 194 Death--Disposition of Dead Bodies Section 194.387 Miscarriage</h2> </P><P>Mother's right to determine final disposition of remains--counseling made available, when. 194.387. <ol><LI> Within twenty-four hours after a miscarriage occurs spontaneously or accidentally at a hospital, outpatient birthing clinic, or any other health care facility, the facility shall disclose to the mother of the miscarried fetus, both orally and in writing, the mother's right to determine the final disposition of the remains of the fetus. The facility's disclosure shall include giving the mother a copy of the facility's written standards adopted pursuant to section 194.384. <LI>The facility shall make counseling concerning the death of the fetus available to the mother. The facility may provide the counseling or refer the mother to another provider of appropriate counseling services. </ol></P> <!-- END OF MISSOURI --> <P><a href="#top">Back to top</a></P> <!-- SOUTH DAKOTA --> <a name=sd><h1>South Dakota</h1></a> <P><h2> AN ACT ENTITLED</h2></P><P> An Act to provide for the disposition of the remains of human embryos and fetuses. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA</P><P> <b>Section 1.</b> Remains of a human embryo or fetus resulting from an abortion or miscarriage, induced or occurring accidentally or spontaneously at a hospital, clinic, or medical facility shall be disposed of in the manner provided by this Act.</P><P> <b>Section 2.</b> Any hospital, clinic, or medical facility in which abortions are induced or occur spontaneously or accidentally or any laboratory to which the remains of human embryos or fetuses are delivered shall arrange for the disposal of the remains by cremation, interment by burial, or by incineration in a medical waste incinerator approved by the Department of Environment and Natural Resources. If incineration is used, the remains of the human embryo or fetus shall be incinerated separately from other medical waste. The hospital, clinic, medical facility, or laboratory may perform any laboratory tests necessary for the health for the woman or her future offspring, or for the purposes of a criminal investigation, or for determination of parentage prior to disposing of the remains.</P><P> <b> Section 3. </b> Any failure to comply with the provisions of this Act constitutes a public nuisance. Any person, firm, or corporation failing to comply with the provisions of this Act is guilty of a Class 1 misdemeanor.</P><P> <b>Section 4.</b> No religious service or ceremony is required as part of the disposition of the remains of a human embryo or fetus. The hospital, clinic, or medical facility shall discuss or disclose the method of disposition with the woman who had the miscarriage.</P><P> <b> Section 5. </b> Tissue and organ donation may occur in cases of spontaneous abortions if the consent of the mother is obtained. </P><P> <b><i>First read 1/20/1998<br> Signed into law 3/14/1998.</i></b> </P> <!-- END OF SOUTH DAKOTA --> <P><a href="#top">Back to top</a></P> <a name=il><h1>Illinois</h1></a> <P> <h2> State of Illinois <br/> 92nd General Assembly<br>Legislation<br/> AN ACT to amend certain Acts in relation to the disposition of certain fetuses. </h2> </P><P> Be it enacted by the People of the State of Illinois, represented in the General Assembly: </P><P> Section 5. The Hospital Licensing Act is amended by adding Section 11.4 as follows: (210 ILCS 85/11.4 new) </P><P> Sec. 11.4. Disposition of fetus. A hospital having custody of a fetus following a spontaneous fetal demise occurring after a gestation period of less than 20 completed weeks must notify the mother of her right to arrange for the burial or cremation of the fetus. Notification may also include other options such as, but not limited to, a ceremony, a certificate, or common burial of fetal tissue. </P><P> If, within 24 hours after being notified under this Section, the mother elects in writing to arrange for the burial or cremation of the fetus, the disposition of the fetus shall be subject to the same laws and rules that apply in the case of a fetal death that occurs in this State after a gestation period of 20 completed weeks or more. The Department of Public Health shall develop forms to be used for notifications and elections under this Section and hospitals shall provide the forms to the mother. </P><P> Section 10. The Vital Records Act is amended by changing </P><P> Section 20 as follows: (410 ILCS 535/20) (from Ch. 111 1/2, par. 73-20) </P><P> Sec. 20. Fetal death; place of registration. </P><P> (1) Each fetal death which occurs in this State after a gestation period of 20 completed weeks (and when the mother HB0382 Enrolled LRB9201013WHcs elects in writing to arrange for the burial or cremation of the fetus under Section 11.4 of the Hospital Licensing Act) or more shall be registered with the local or subregistrar of the district in which the delivery occurred within 7 days after the delivery and before removal of the fetus from the State, except as provided by regulation in special problem cases. </P><P> (a) For the purposes of this Section, if the place of fetal death is unknown, a fetal death certificate shall be filed in the registration district in which a dead fetus is found, which shall be considered the place of fetal death. </P><P> (b) When a fetal death occurs on a moving conveyance, the city, village, township, or road district in which the fetus is first removed from the conveyance shall be considered the place of delivery and a fetal death certificate shall be filed in the registration district in which the place is located. </P><P> (c) The funeral director or person acting as such who first assumes custody of a fetus shall file the<br>21 certificate. The personal data shall be obtained from the best qualified person or source available. The name, relationship, and address of the informant shall be entered on the certificate. The date, place, and method of final disposition of the fetus shall be recorded over the personal signature and address of the funeral director responsible for the disposition. The certificate shall be presented to the person responsible for completing the medical certification of the cause of death. </P><P> (2) The medical certification shall be completed and signed within 24 hours after delivery by the physician in attendance at or after delivery, except when investigation is required under Division 3-3 of Article 3 of the Counties Code HB0382 Enrolled LRB9201013WHcs and except as provided by regulation in special problem cases. </P><P> (3) When a fetal death occurs without medical attendance upon the mother at or after the delivery, or when investigation is required under Division 3-3 of Article 3 of the Counties Code, the coroner shall be responsible for the completion of the fetal death certificate and shall sign the medical certification within 24 hours after the delivery or the finding of the fetus, except as provided by regulation in special problem cases. </P><P> <b>(Source: P.A. 88-159.)<br/> 1/30/2001 First Reading 8/15/2001 Governor Approved.</b> </P> <P><a href="#top">Back to top</a></P> <a name=mas><h1>Massachusetts</h1></a> <P><h2> PART I. ADMINISTRATION OF THE GOVERNMENT <br/> TITLE XVI.PUBLIC HEALTH<br/> CHAPTER 111. PUBLIC HEALTH<br/> MISCELLANEOUS PROVISIONS </h2></p> <P> Chapter 111: Section 202 Fetal deaths; reports; confidentiality; disposition of remains; violations; forms </P><P> Section 202. As used in this section, 'fetal death' means death prior to the complete expulsion or extraction from its mother of a fetus, irrespective of the duration of pregnancy, as indicated by the fact that after such expulsion or extraction the fetus does not breathe or show any other evidence of life such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles. 'Fetal death' does not include an abortion as defined in section twelve K of chapter one hundred and twelve. </P><P> When a fetal death occurs in a hospital, if a fetus is of twenty weeks gestation or more, or a weight of three hundred and fifty grams or more, the physician in attendance shall prepare and transmit a report of such death to the person in charge of the hospital or his designated representative, who shall file such report with the commissioner within ten days after such death. </P><P> When a fetal death occurs outside a hospital, if a fetus is of twenty weeks gestation or more, or a weight of three hundred and fifty grams or more, the physician in attendance at or immediately after delivery shall prepare and file a report of such death with said commissioner within ten days after such death. </P><P> When a fetal death occurs without medical attendance at or immediately after delivery or when the fetal death may have occurred from violence or unnatural causes, if a fetus is of twenty weeks gestation or more, or a weight of three hundred and fifty grams or more, the medical examiner shall investigate the cause and shall prepare and file a report of such death with said commissioner within ten days after such death. </P><P> Said commissioner may compile an annual statistical report of fetal deaths, and may make such further use of such records as he deems useful for administrative and research purposes connected with health programs and population studies. </P><P> Fetal death reports shall be confidential and shall be released by the department only upon written request of the parent, his or her guardian, executor, attorney, or any other person designated by the parent in writing. Such reports may also be released to the National Center for Health Statistics in the Department of Health, Education and Welfare, and to persons authorized by said commissioner under section twenty-four A of this chapter to conduct research studies. The department may release copies of such reports, or information contained therein, to other persons only in a manner which does not allow identification of the parents. </P><P> <b><i> Disposition of fetal remains shall be made at the direction of the parent in either manner as hereinafter provided: </b></i>the remains may be buried, entombed or cremated in accordance with chapter one hundred and fourteen and a copy of a report required by this section shall constitute the certificate required by section forty-five of said chapter one hundred and fourteen. Said copy shall, within thirty days after the issuance of a burial permit, be destroyed by the local board of health; or in all other circumstances, the fetal remains shall be disposed of by the hospital or as directed by the attending physician or medical examiner in a manner which does not create a hazard to the public health. Such disposition shall not be subject to the provisions of said chapter one hundred and fourteen. Before disposition, the physician or person in charge of the hospital shall ensure that the parent is informed of his right to direct either burial, entombment or cremation of the fetal remains, or disposal of the remains by the hospital or physician. Before disposition, the parent shall be informed in writing of the hospital policy relating to disposal of fetal remains, and shall be informed of the availability of a chaplain if any for counsel. </P><P> The provisions of chapter forty-six regarding the reporting of deaths shall not apply to fetal deaths. </P><P> A physician or medical examiner neglecting or refusing to file a report required by this section, or who makes a false statement therein, shall be subject to a fine of not more than fifty dollars. </P><P> The commissioner shall prescribe the form for the making of reports under this section, which shall be consistent with the United States standard report of fetal death. </P> <P><a href="#top">Back to top</a></P> <a name=ar><h1>Arkansas</h1></a> <P><h2> Arkansas Legislature<br>20-17-801. Fetus and tissue generally.</h2> </P><P> (a)(1) Any physician removing or otherwise acquiring any tissue of the human body may, in his discretion, after making or causing to be made such scientific examination of the tissue as he may deem appropriate or as may be required by law, custom, or rules and regulations of the hospital or other institution in which the tissue may have been removed or acquired, authorize disposition of the tissue by incineration, cremation, burial, or other sanitary method approved by the State Board of Health. The physician may authorize the disposition pursuant to this subsection (a) unless he has been furnished, prior to removal or acquisition of the tissue or at any time prior to its disposal, a written request that the tissue shall be delivered to the patient or someone in his behalf or, if death has occurred, to the person claiming the dead body for burial or cremation. </P><P> (2) No tissue shall be delivered, however, except as may be permitted by rules and regulations of the board. </P><P> (3) Any hospital or other institution acquiring possession of any tissue and not having written instructions to the contrary from the attending physician, the patient, or the person claiming a dead body for burial or cremation, or someone acting in their behalf, may immediately dispose of the tissue as provided for in this subsection (a). (b) No external member of the human body may be disposed of pursuant to subsection (a) of this section within forty-eight (48) hours of its removal or acquisition unless consent thereto is obtained in writing from the patient or the person authorizing the medical or surgical treatment of the patient, and<b><i> no dead fetus shall be so disposed of within the same period of time unless consent thereto is obtained in writing from the mother of the dead fetus or the mother's spouse. </b></i> </P><P> (1) For the purposes of this section, an external member of the human body is defined as an arm or one (1) or more joints thereof, a hand, a finger or one (1) or more joints thereof, a leg or one (1) or more joints thereof, a foot, a toe or one (1) or more joints thereof, an ear or the greater part thereof, or the nose or the greater part thereof. </P><P> (2) For the purposes of this section, a dead fetus is defined as a product of human conception exclusive of its placenta or connective tissue, which has suffered death prior to its complete expulsion or extraction from the mother as established by the fact that, after the expulsion or extraction the fetus does not breathe or show any other evidence of life, such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles. </P><P> (c) The board shall promulgate all reasonable and necessary rules and regulations to effectuate the provisions of this section. </P><P> History.
